Affirmative Action 2.0
Soothsayers watching the Supreme Court think that the diversity based affirmative action programs are headed to the trash can. The programs were always a kind of blind run around raced based admissions but were tolerated by the courts. The fact that they were opaque to outsiders stoked a lot of frustration and suspicion about their actual design. It now looks like a day of reconning is coming. If they fall to a strict interpretation of the 14th amendment, what avenues do you think are still available for historically disadvantaged groups? Or do you think that this problem is fading away? One of our recent book club books suggested an approach to this problem based on a negotiated vision of rights, but that seems to run contrary to the present court direction. Any ideas for replacing a century of economic and social capital destruction within the current political environment?
